Terms and Conditions:


TheAtlasRoamers aim to provide educational and creative enrichment for photography tours, photography Workshops and Private guided tours or Private guided workshops as outlined on this website as a sponsoring organization and has qualified professional guides, instructors and tour operators to organize and administer all the mentioned above activities.

Release of Liability:

By booking one of the workshops created by TheAtlasRoamers, participants certify that they have carefully read the requirements and the “Terms & Conditions” for the Expedition / Workshop and are aware that the workshop involves the risk of personal injury, death or loss (damage) to property.  In consideration of the benefits derived by the workshop, participants recognize and accept all risks.Therefore, the participants completely understand that TheAtlasRoamers have no responsibility for the pre-mentioned (including but not limited to liability for delays, monetary damages, illness, injuries, death, or for the loss of or damage to property resulting directly or indirectly from any occurrences or conditions).
Participants agree to comply with the aforementioned terms “Terms & Conditions” and other sections as stated above. Participants confirm the fact that they have a medical insurance covered that is international (valid overseas) as well as that they do not expect any additional oral or written representation of theAtlasRoamers for implementing this release. Participants thus acknowledge receipt of this release, understand and accept its terms and conditions. Any questions participants might had regarding the release have been fully explained.
TheAtlasroamers organize, disseminate and sell the tour along with some services bought by other suppliers. The suppliers are separate contractors and do not constitute agents or employees of theAtlasRoamers. The services offered by such contractors include, but are not limited to, transportation, accommodations, meals, and excursions using local guides. TheAtlasRoamers, although counting on reliable suppliers to assure a pleasant experience, cannot be held responsible for the willful or negligent acts and/or omissions of the above-mentioned suppliers. All the arrangements regarding the tours are subject to the terms and conditions declared by the suppliers, air carriers and/or applicable governing laws. TheAtlasRoamers and the suppliers offering transportation or any service have no responsibility for any potential loss or additional expenses due to, but not limited to, delays, changes to or cancellation of itinerary, sickness, weather, strike, war, quarantine, terrorism, defects in vehicles, breakdown in equipment, animals including transportation by animals, hiking, and any act, omission, negligence or other causes beyond their control. All losses or expenses caused by the above-mentioned factors will burden the clients that agree to the given terms and conditions, as the Tour rates provide for arrangements only for the specific time stated. TheAtlasRoamers cannot be held responsible for expenses occur by members of the tours while preparing for the Trip (i.e.: air tickets, visa/passport fees, equipment, medical expenses, individual transfers, etc.).


Accountability for Risk:

Potential participants travel being aware that this experience includes some inherent risks, but not limited to, forces of nature, terrorism, civil unrest, strikes, wild animals (including animals used for transportation), all activities including hiking over rough terrain, theft, cancellation or changes in itinerary, negligent action of others or their agencies, or means of conveyance or accommodation which may not be operated nor maintained to standards common in Western countries like the United States. Health-related issues are included, and participants need to be aware that medical services or facilities may not be readily available or accessible throughout all or part of the Tour. Emergency medical care, presence of physicians, and adequate medication are also included to the limitations mentioned above. On tours of such type persons with severe health problems, physical disabilities or mental illness cannot participate due to those limitations. The participant is accountable for judging the appropriateness of the tour activities to his/her own physical and mental capacity. By forwarding the deposit, the participants  declare they agree with these terms and conditions and that they do not have any mental, physical or other condition or disability that would constitute a threat for them or other participants. TheAtlasRoamers and their contractors cannot be held responsible for any special arrangements or problems incurred by participants unable to participate in the tour or planned activities. The right is reserved to decline any person as a member of the Trip, or to require any participant to withdraw from the Trip at any time.


Fitness and Health:

Anyone who is reasonably fit should be able to take part in the Tour. You might feel general fatigue due to long flights and changes in time zones. Also you may need to be adequately flexible to climb in and out of the transport vehicles and be able to manage your own photographic equipment and luggage. You might need to hike trails and paths varying from easy to moderate throughout the tour. Some accommodation facilities may not be equipped with elevators or air-conditioning.

Please note that medical services and facilities might not be readily available during all or part of the Tour. This might entail emergency medical care or adequate medication. Please let us know us in advance of any allergies, physical / mental conditions or medications you’re currently under that may affect your health.

Changes in Services:

We reserve the right to change the tour dates, itinerary, or accommodations as conditions warrant. We reserve the right to change the itinerary due to, but not limited to, weather conditions, political conditions and other factors beyond our control without consulting the participants. It is understood that such decisions will be made in the best interests of all participants and with regards to safety first. Participants have no right to any refund or other considerations in the event of these inevitable itinerary changes. If a trip must be delayed, or the itinerary changed due to bad weather, road conditions, transportation delays, government intervention, sickness, volcanic eruption or other contingency, the cost of delays or changes is not included.

Rates are based on tariffs, EURO exchange rates and supplier fees in effect at the time of publishing. We reserve the right to alter our prices. Individual transfers for those traveling independently are not included unless otherwise stated. We reserve the right to cancel the tour before departure for any reason whatsoever, including too few participants or logistical problems such as strikes, wars, acts of God, volcanic eruptions, or any other circumstances which may make operation of the trip inadvisable. If the trip is possible with a small group then it may not be cancelled but a supplemental fee will be required. If the trip is cancelled because of the small number of participants booked until the last 30 days then all the payments received will be promptly refunded. However, we are not responsible for any expenses incurred by trip members in preparing for the trip, including non-refundable or penalty-carrying airline tickets, special clothing, visa or passport fees or other trip related expenses. Accommodations are based on double occupancy (two people sharing a room) requests for single occupancy are assigned on a first-come, first-served basis, when available and subject to a supplemental fee at the rate stated on the individual trip website page. The Tour Operators reserve the right to cancel or make changes to the published itinerary, including removal or substitution of tour leaders, whenever, in its judgment, conditions warrant, without consulting the participants. Participants have no right to any refund or other considerations in the event of these itinerary or leader changes. If changes occur, tour leaders will plan each day considering the interests of the group and the weather at hand. Be assured that we will make substitutions that are similar in quality and interest when possible.


Code of Conduct:

Participants are expected to conduct themselves in a manner that is respectful to the group and other participants. Any use of illegal drugs or substances, committing or participating in any criminal or illegal activity & violence of any sort will not be tolerated and will result in the participant’s immediate removal from the Trip, without refund and at the participant’s expense. Trip leaders are authorized, and hereby reserve the right, to remove or exclude participants from the Trip.

Included & NOT included:

Everything mentioned as included on the listing of the trip is included in the price and everything that is mentioned as not included, is not included in the price. The airfare is not included in the price, also visas and passport fees are not included, side activities taken on your own are not included  in the price. It is possible to arrange all these costs before booking a private workshop but not before booking a normal workshop. However, a 4 month notice in advance is required. Normally, the costs of gasoline, parking fees, accommodations based on double occupancy and the payment of the tour leader(s) are included. However, every listing reservers the right to be different and include or exclude different expenses. A limited number of single rooms/cabins are available at an extra cost on a first-come, first-served basis that is mentioned in the listing. We will assist persons requesting a roommate. Participants will be notified if a suitable roommate is not available, in which case the single rate will be charged.

Indemnification:


The participant agrees to defend and indemnify the Tour Operators, and its affiliate companies from and against any and all demands, claims or lawsuits (including without limitation, third party asserted demands, claims or lawsuits), actions, liabilities, damages, costs, losses and/or expenses (including reasonable attorneys’ fees and expenses) (collectively, “Claims and Damages”) which the Tour Operator may incur, suffer or be required to pay by reason of actions taken by the Participant, including those which result in damage to property owned by third parties, or any other Claims and Damages arising in connection with a third party claim suffered due to actions taken by the Participant. The Participant is liable to reimburse the Tour Operators for any Claims and Damages collected by third parties, during the Trip or after, as a result of or related to actions taken by the Participant.

Travel Insurance:


Each of the clients that will participate in TheAtlasRoamers tours hereby confirms that understands and consents to buy the required insurance mentioned below, that is valid internationally, and that they will be asked to provide proof before their departure for the Tour and in order to participate.

We kindly advise you to evaluate your risk and to get travel insurance that covers the full value of the Trip and personal effects in the case of tour cancellation, loss or theft of baggage, and emergency evacuation. No representative of TheAtlasRoamers or their contractors will be held responsible for these expenses. It is crucial for you to realize that in case of a delay or if you find it necessary to cancel or cut short the Tour for any reason, you will lose part or the entire sum of the amount paid.

Travel insurance is a way to minimize the risk of monetary losses you would have in the case of a delay of your departure due to weather, airline strike, missed connection, etc., a burden in your travel for any personal reason or under any circumstances.

There are certain limitations on any insurance program. Hence, we suggest that you read carefully the fine print of your insurance policy.

Model Release:

TheAtlasroamers and its designated tour guides and leaders obtain the right to take photographs or videos throughout the tours and to use them for promotional or commercial use. By making a reservation on TheAtlasRoamers, the participant gives his/her consent to allow his/her likeness to be used by TheAtlasroamers, their authorized third parties, and the tour guides without compensation to the participant. If a client does not wish his or her likeness be used, he/she must provide us with a written notification prior to departure of the expedition.
Photo Release: Copyright in all photographs, video, and related material (herein referred to as “Trip Materials”) created by the participants belong to them upon creation. The latter gives his/her consent to the Tour guides a non-exclusive, worldwide, irrevocable license to use any Trip Materials voluntarily provided to TheAtlasRoamers in any media for the above mentioned purposes: editorial use, promotion of this editorial use, advertising and promotion of TheAtlasroamers or Workshops offered by them.

Food and Drink:

Lunches will be casual, mostly served in places convenient to the shooting areas. This will allow maximum flexibility to the participants regarding their photoshooting chances.

Accommodations:

Accommodation facilities can be simple in some cases, where there is not a more comfortable choice available in the location.

Dispute Resolution:


If a participant has a complaint, he/she should first inform the tour guide while on the Trip so that he/she can attempt to resolve the matter. If the participant remains dissatisfied, he/she can submit the complaint in writing to TheAtlasroamers within 30 days of the completion of the tour.
Any controversy or dispute arising out of or relating to this Agreement or any other literature concerning this Tour, including without limitation any claim regarding health issues or death, shall be subject to the following conditions: 1) the dispute will be solved by Greek law; 2) the parties agree that they will try to settle any or all conflicts arising out of this Agreement, including without limitation the validity, interpretation, performance and breach hereof, through a mediation in Greece under the supervision of a mutually agreed upon mediator; 3) in the case that mediation fails to resolve such an issue, the parties agree that they will proceed to arbitration in Greece; 4) the maximum amount of recompensation to which a participant will be entitled under any circumstance will be the published cost of the participant’s Tour with TheAtlasroamers.

Other:

By signing up for a trip with Atlas Roamers, the Participant agrees to the Disclaimer and the Terms and Conditions published on the Website or in any printed material.
Participants confirm that they have checked and agreed with the dates and costs of the trip and that they understand that the flights or anything else listed in the “Not Ιncluded” category is not included in the cost.
By signing up, signing up for a registration form, and paying a deposit for a program managed by Atlas Roamers, you confirm that you are fully aware and fully agree to our Terms and Conditions.
Final Payment (full payment) is required within 90 days prior to departure for the trip or participants are at risk of losing their deposit and being confiscated at the point where they are registered with a participant in the waiting list.
